Litigation means taking your dispute to court, where a judge (or jury) hears both sides and makes a binding decision. The adversarial nature of court proceedings often damages relationships beyond repair and may not result in an outcome either party finds satisfactory.

When Litigation May Be Necessary

Sometimes litigation is the only option: when one party refuses to participate in good faith negotiation; when fraud or criminal activity is involved; when you need to establish legal precedent; or when the other party is unlikely to comply with a mediated agreement. Even then, many courts require mediation attempts before proceeding to trial.
