These Terms of Service ("Terms") govern your use of the Sunwest Escrow, LC website (sunwestescrow.com) and related services. By using our website or services, you agree to these Terms.
2. Escrow Services
Sunwest Escrow, LC provides long-term escrow services for real estate transactions in the state of New Mexico. Our services include payment collection and disbursement, tax and insurance payment management, document management, and related escrow functions as outlined in individual escrow agreements.
3. Client Responsibilities
As a client of Sunwest Escrow, you are responsible for:
- Making timely payments as outlined in your escrow agreement
- Submitting property tax bills and insurance renewal notices promptly upon receipt
- Maintaining accurate contact information with our office
- Reviewing statements and correspondence from Sunwest Escrow in a timely manner
- Notifying Sunwest Escrow of any changes to the property or contract terms
4. Tax and Insurance Bill Submission
If your escrow account includes tax and/or insurance disbursements, it is your responsibility to forward all related bills and notices to Sunwest Escrow promptly upon receipt. Failure to submit bills in a timely manner may result in late payment penalties or lapses in coverage for which Sunwest Escrow is not responsible.
5. Online Portal (NoteServe)
Access to the NoteServe online portal is provided as a convenience for active escrow clients. You are responsible for maintaining the security of your login credentials. Sunwest Escrow is not responsible for unauthorized access resulting from compromised credentials.
6. Fees and Payments
All fees are outlined in your individual escrow agreement. Fee schedules are available on our Pricing page and upon request. Sunwest Escrow reserves the right to update fee schedules with appropriate notice to affected clients.
7. Mediation Services
Mediation services provided by Sunwest Escrow are intended to facilitate dispute resolution between parties. Mediation outcomes are not legally binding unless formalized in a separate agreement signed by all parties.
8. Limitation of Liability
Sunwest Escrow acts as a neutral third-party escrow agent. We are not responsible for disputes between buyers and sellers, property condition issues, or the enforcement of contract terms between parties. Our liability is limited to the faithful execution of escrow instructions as outlined in individual agreements.
9. Website Use
This website is provided for informational purposes. While we strive to keep all information accurate and current, Sunwest Escrow does not guarantee the completeness or accuracy of website content. Nothing on this website constitutes legal or financial advice.
10. Governing Law
These Terms are governed by the laws of the State of New Mexico. Any disputes arising from these Terms shall be resolved in the courts of Bernalillo County, New Mexico.
